Liability Waiver

What this document is

This is the waiver, release of liability, and assumption of risk agreement for Race Across Toronto, a fundraising scavenger race organized by The Project Noor. You accept it when you check the liability waiver box during registration. Please read it fully before registering.

Assumption of risk

Race Across Toronto takes place in public spaces across the City of Toronto. Participation involves walking, moving quickly between locations, using public transit, and being outdoors in changing weather. I understand and voluntarily accept the risks involved, which include but are not limited to:

• Slips, trips, falls, sprains, fractures, and other physical injury.
• Traffic, cyclists, vehicles, construction, and crowded sidewalks or transit.
• Heat, cold, rain, snow, ice, and other weather conditions.
• Illness, exhaustion, dehydration, or aggravation of a pre-existing condition.
• Actions of other participants, members of the public, or third parties.
• Loss, theft, or damage to personal property including phones used for submissions.

Release of liability

To the fullest extent permitted by law, I release and hold harmless The Project Noor, its founders, organizers, volunteers, sponsors, and partners from any claim, demand, loss, or liability for injury, death, illness, or property damage arising from my participation in the event, except where caused by their gross negligence or wilful misconduct. Nothing in this waiver limits rights that cannot be waived under Ontario law.

My responsibilities as a participant

• I am physically able to take part, or I have medical clearance to do so.
• I will obey all laws, traffic signals, transit rules, and property rules at all times.
• I will not trespass, climb, damage property, or enter restricted or closed areas.
• I will not run into traffic and will cross only at designated crossings.
• I will not consume alcohol or drugs during the race.
• I will follow organizer and volunteer instructions and stop immediately if the race is paused.
• I will call 911 first in a real emergency and then notify event HQ.

Medical consent

If I am injured or become ill during the event and cannot give consent myself, I authorize organizers to arrange emergency medical care and to contact the emergency contact I provided at registration. I am responsible for any medical or transport costs that are not covered by my own insurance or provincial health coverage.

Participants under 16

A participant under 16 may only take part with a parent or guardian who has completed the guardian consent section at registration, and that parent or guardian must supervise the participant in person for the entire event. By giving consent, the parent or guardian accepts this waiver on behalf of the minor and on their own behalf.

Photo and video release

Where I have given photo release consent at registration, I agree that photos and video taken at the event may be used by The Project Noor for fundraising, social media, and reporting, without payment. I may withdraw this consent by contacting us.

Removal and disqualification

Organizers may disqualify or remove any participant for unsafe behaviour, cheating, harassment, or breaking these terms. Removal for these reasons does not entitle the participant to a refund.

Tickets and refunds

Registration is $5 CAD per person, or $20 CAD for a full team of five. Tickets are a donation to The Project Noor and are non-refundable, except that if organizers cancel the event outright and it is not rescheduled, we will refund ticket payments. If the event is postponed for weather or safety, tickets carry over to the new date.

Governing law

This agreement is governed by the laws of the Province of Ontario and the applicable laws of Canada. If any part of it is found unenforceable, the remaining parts stay in effect.
